Ratio Decidendi

The Supreme Court held that the seller (or their legal successor) is liable to restore the full value of the property to the buyer when the sale is rescinded due to lack of title, and that the party whose fault caused the loss is liable for damages. Land sale contracts must be in authentic form and registered. Compensation for unlawful dismissal is based on net salary, and lumpsum benefits are included if contractually due. Loan interest accrues until repayment but is capped at principal. Equal pay for equal work is required unless justified. Lawyers must prove mandate if challenged. Joinder is limited to cases at the same stage. Unappealed issues cannot be raised in review.
