Procedural Posture

Labour Dispute (employment Termination) / Court of Appeal Judgment on Review for Injustice

  1. 1 Whether Niwemungeli Marie Thérèse was entitled to higher compensation for unlawful dismissal based on her length of service and in parity with similarly situated employees
  2. 2 Whether the previous judgments failed to apply the law equally regarding compensation for employees with similar tenure
  3. 3 Whether the applicant is entitled to costs and attorney fees

Ratio Decidendi

The Court of Appeal held that Niwemungeli Marie Thérèse, having served over ten years and being unlawfully dismissed, was entitled to compensation equal to nine months of her last salary, in parity with another employee (Nsanzabandi Rushemeza Charles) with similar tenure who received the same. The previous lower court decisions failed to justify the discrepancy in awards, violating the principle of equality before the law. The court ordered BPR Bank Rwanda Plc to pay the difference between what was previously awarded (five months' salary) and the correct amount (nine months' salary), as well as partial costs and attorney fees.

Court Disposition

Appeal allowed in part; previous judgment modified regarding compensation and costs.
