The Supreme Court held that the sale of succession property by Habimana Jean Léo Pasteur without the written consent of his co-heir Nyirahabimana Umwali Roselyne was invalid as to her share. Nyirahabimana could not seek annulment of the contract itself but was entitled to recover the value of her 50% share from those who acquired the property in bad faith, namely Habimana, Ndagijimana, Sakindi, and Munyandekwe. Compensation was to be based on the current value of the property. Purchasers in good faith of subdivided plots were not liable.
