The Supreme Court held that article 1(5) of Law Nº74/2008, while treating taxpayer litigants differently from other litigants, does not constitute unconstitutional discrimination or inequality before the law. The differentiation is justified by the special status and legal obligations of taxpayers to keep and produce account statements during audits. The restriction serves a legitimate public interest and is proportionate to its objective. Therefore, the provision is not inconsistent with articles 15 and 16 of the Constitution.
