  1. 1 Whether Birungi Kakiga Godfrey and Munezero Espérance lawfully acquired plot No 531
  2. 2 What the true source/title history of plot No 531 was
  3. 3 Whether the lower court erred in ordering costs against Bayito Innocent and Tuyisenge Ida Gaudence

Ratio Decidendi

Although Birungi Kakiga Godfrey and Munezero Espérance bought the plot in good faith, they bought it from persons who were not the true owners. Saleh Salim Al Farsy proved the property's origin and his superior right, supported by a final criminal judgment convicting Bayito Innocent of fraudulently obtaining the plot documents and selling another's property. Therefore, the plot had to be restored to Saleh, while Birungi and Munezero were entitled to compensation from the sellers for the plot's current value, not retention of the property.

Court Disposition

Appeal partially upheld; lower-court judgment revised on the merits after rehearing for injustice
