SIMACO Ltd was defeated in both lower courts on the same legal ground—failure to comply with mandatory procedural requirements for challenging the auction—thus, under Article 52(3) of Law No 30/2018, the second appeal is inadmissible. The procedural defect was the same in both instances: SIMACO Ltd wrote to the Registrar General before receiving the auction report and filed suit on the same day it received the report, contrary to the prescribed procedure.
