Confessions made during investigation, even if retracted at trial, may be considered by the court at its discretion. Mitigating circumstances do not obligate the court to reduce sentence. The standard of proof in criminal cases is proof beyond reasonable doubt. Testimony from victims or relatives is admissible and its weight is for the court to assess. New evidence for retrial must be evidence that could not have been discovered with reasonable diligence at the time of the original trial.
