Procedural Posture

Application for Review (grounds of Injustice) / Court of Appeal Judgment

  1. 1 Whether the application for review due to injustice should be declared inadmissible for lack of standing and interest to sue
  2. 2 Whether the High Court failed to examine if previous judgments were final regarding rectification of the registration certificate
  3. 3 Whether the registration certificate can be corrected for demarcation of the passage

Ratio Decidendi

Uwamahoro had standing and interest as she inherited rights to the passage from her mother, and was deprived of easement to her home. Previous judgments did not finally resolve the rectification of the registration certificate or the demarcation of the passage. The registration certificate can be rectified to demarcate the public passage. Habimana is liable for damages for depriving Uwamahoro of use of her car, but only to the extent proven. The High Court judgment was quashed for failing to address these issues.

Court Disposition

Application for review admitted; High Court judgment quashed; orders issued for demarcation, removal of constructions, damages, and costs.

Orders

  • RLMUA to demarcate the passage from UPI: 1/02/13/03/1120 (Habimana's plot), restoring former dimensions.
  • Habimana to remove constructions on the passage within one month or face compulsory execution.
