Wilson's Trustees v. James Watson & Co. [1900] ScotLR 37_545 (14 March 1900)

Wilson's Trustees v. James Watson & Co. [1900] ScotLR 37_545 (14 March 1900)

Creditors under a trust-deed for creditors are entitled to claim full interest on their debts out of a surplus remaining after payment of principal and agreed interest, and the trustees' prior appropriation of payments to principal does not bar such claims. The emergence of a surplus revives the creditors' rights to interest, and the doctrine of appropriation of payments by a debtor does not apply to payments made by trustees for creditors.

Procedural Posture

Multiplepoinding (distribution of Surplus Trust Funds) / Inner House, Second Division, on Reclaiming Motion (appeal) Against Lord Ordinary's Interlocutor

  1. 1 Whether creditors under a trust-deed for creditors are entitled to claim further interest out of a surplus after principal and agreed interest have been paid
  2. 2 Whether payments made by trustees can be appropriated to principal or interest so as to bar further claims for interest by creditors
  3. 3 Whether the emergence of a surplus revives creditors' rights to interest beyond what was originally paid

Ratio Decidendi

Creditors under a trust-deed for creditors are entitled to claim full interest on their debts out of a surplus remaining after payment of principal and agreed interest, and the trustees' prior appropriation of payments to principal does not bar such claims. The emergence of a surplus revives the creditors' rights to interest, and the doctrine of appropriation of payments by a debtor does not apply to payments made by trustees for creditors.

Court Disposition
