Humphreyr v. Weir [2005] ScotSC 33 (22 June 2005)
The court held that the matrimonial property, including the home and pension, should be divided equally, with the home to be sold and the proceeds divided after deduction of the mortgage, associated policy proceeds, and adjustment for payments made by the defender since separation. No special circumstances justified a departure from equal division. The increase in value of the jointly owned home since separation should be shared equally. The pursuer was entitled to a capital sum in respect of the pension, and interest was to run from the date the Minute of Agreement was set aside.
