Primary Healthcare Centres (Broadfoot) Ltd v Humphrey [2010] ScotCS CSOH_129 (16 September 2010)
The decree of absolvitor in favour of Dr Ravangave and Dr Turville removed any subsisting liability they had to the landlords, thereby extinguishing Dr Humphrey's right of relief against them. As a result, the landlords' claim against Dr Humphrey is limited to his one-third pro rata share of the former partnership's liabilities under the lease. The pleas of res judicata, waiver, and personal bar advanced by Dr Humphrey are irrelevant. Section 9 of the 1856 Act does not apply to partners' liability for partnership debts.
