Macfarlane's Trustee v. Macfarlane [1903] ScotLR 41_164 (10 December 1903)
The trustees' minute of 7 July 1885 was an irrevocable exercise of their powers under the codicil, apportioning and setting apart a share for Alexander Goodsir Macfarlane. The protective provisions regarding income did not prevent vesting of the fee in him. Accordingly, the share vested in Alexander Goodsir Macfarlane from the date of the minute, and passed under his settlement upon his death.
