The notice given by National Express was fundamentally defective as it did not provide a statement of the net assets of Bruce's Coaches Limited or bring out a balance between assets and liabilities as required by warranty B.10. Without such a statement, the contractual requirements for notice were not met, and the claim could not be remedied after the fact. Accordingly, the defenders were entitled to be assoilzied (absolved) from liability.
