The appellants, Gibson & Co., were the employers of the respondent because they engaged, instructed, superintended, and paid the respondent for the trimming work, and had direct dealings with him. The head of the squad's power to select or dismiss did not alter the fact that the appellants were the true employers. The Dock Commissioners and shipowners were not employers for the purposes of the Act. The appellants are liable in compensation under the Workmen's Compensation Act 1906.
