Ratio Decidendi

The trial judge erred in law by releasing the entire sum of €100,000 under section 35(6) of AMLA, which only permits release of funds essential for living and legal expenses, and by failing to properly consider the forfeiture application and the statutory burden-shifting provisions. The respondent failed to discharge the burden of proving the money was not proceeds of crime. The appeal is allowed and the sum is forfeited to the Republic.
