Ratio Decidendi

The 1971 agreement was a valid promise of sale under the French Code Civil, equivalent to a sale upon mutual agreement on the thing and price. Non-registration did not affect the rights between the parties, and the appellant became owner in 1971. The trial judge erred in applying later law and in finding the transaction void for lack of registration. The appeal is allowed, and the appellant is declared owner with registration to be effected.
