Procedural Posture

Civil Appeal / Judgment After Appeal From Constitutional Court

  1. 1 Whether the Government is under an obligation to return compulsorily acquired land under Section 14(1)(a) of Schedule 7 to the Constitution where the land has not been developed or there is no plan to develop it
  2. 2 Proper interpretation of 'land which has not been developed' under the Constitution

Ratio Decidendi

The Government is not under an obligation to return land compulsorily acquired under the Lands Acquisition Act 1977 where the land has been developed or has a building, as compensation would have been paid on a market value basis. The plain and ordinary meaning of Section 14(1)(a) of Schedule 7 to the Constitution does not require the Government to return such land, and the interpretation advanced by the appellant is not supported by the text or legislative intent.
