Nilsen and Another v Confait and Another (106 of 2001) [2009] SCSC 25 (6 May 2009)
The defendants unlawfully encroached on the plaintiffs’ property by constructing part of their building, including a roof, across the boundary and onto PR10 without consent, destroying a boundary beacon in the process. The wall in question was not a party-wall but was built entirely on the plaintiffs’ land. The defendants failed to prove their counterclaim of encroachment by the plaintiffs. Plaintiffs are entitled to demolition of the encroaching structures, cessation of trespass, and damages as claimed.
