The forthcoming election was a general election, not by-elections, as dissolution of the Assembly vacates all seats and requires a general election under Section 12(2)(c) of the Elections Act, which is not inconsistent with Article 79(2) of the Constitution. The Electoral Commissioner acted constitutionally in fixing the election dates.
