Ratio Decidendi

There is no evidence to support the respondent's claim that the petitioner is entitled to only 11,183m² or that the respondent is entitled to 33,941m². Both parties are registered as joint proprietors with a qualified title, and in the absence of evidence to the contrary, are presumed to own equal shares. The petitioner and respondent are each entitled to a half share in parcel S1961.

Court Disposition

Petition allowed. Appraiser appointed.

Orders

  • Mr. Antoine Ah-Kong of Ah-Kong Land Surveys is appointed to carry out an appraisement of title S1961 and submit a report proposing partition so that the parties may obtain a half share each, on or before 31st August 2020.
  • The costs of the appraisement will be borne in equal shares by the parties.
