The defendants' excavation and construction works were the primary cause of the damage to the plaintiff's building, as they failed to take necessary precautions to prevent soil movement and settlement, constituting a fault and abuse of rights under Article 1382. The 1st defendant is vicariously liable for the acts of the 2nd defendant under Article 1384(1). However, there was contributory negligence by the plaintiff's contractors and engineers in the design and construction of the building, warranting a reduction of 35% in the damages awarded. The plaintiff is entitled to 65% of the actual damages, with interest at the legal rate.
