Procedural Posture

Forfeiture Application (anti Money Laundering) / Ruling on Motion

  1. 1 Whether the cash seized from the Respondent represents proceeds of crime or is intended for use in connection with criminal conduct under the AMLCFT Act
  2. 2 Whether the Applicant has established reasonable grounds for forfeiture under Section 76(1) of the AMLCFT Act

Ratio Decidendi

The court found that the Applicant established reasonable grounds for suspecting the cash seized from the Respondent directly or indirectly represented the Respondent's benefit from, or was intended for use in connection with, the offence of money laundering. The Respondent failed to provide sufficient evidence to prove the legitimate source of the cash or to rebut the suspicion of criminal conduct. Therefore, the court exercised its discretion under Section 76(1) of the AMLCFT Act to order forfeiture of the entire sum seized.
