Ratio Decidendi

There was a valid contract of sale as Adeline's consent was not vitiated by mistake or incapacity on the evidence and pleadings. The contract need not be rescinded as Talma paid a substantial amount, but the correct outstanding balance is SCR 377,485.87 plus legal interest from the date of agreement. Talma must pay this within one month for transfer of the property, failing which Adeline must reimburse the total sum paid.
