Procedural Posture

Civil Appeal / Appeal From Supreme Court Decision

  1. 1 Whether the Supreme Court of Seychelles has jurisdiction to recognise and enforce a foreign arbitral award under the New York Convention or English law
  2. 2 Whether Articles 146-150 of the Commercial Code are effective for enforcement of foreign arbitral awards
  3. 3 Whether the Supreme Court can resort to English law via section 4 of the Courts Act to enforce foreign arbitral awards

Ratio Decidendi

The Supreme Court of Seychelles does not have jurisdiction to enforce the foreign arbitral award because the New York Convention is not applicable, Articles 146-150 of the Commercial Code have no legal effect due to Seychelles' repudiation of treaty succession and lack of ratification, and section 4 of the Courts Act cannot be used to import English statutory law to create jurisdiction contrary to the Constitution.

Court Disposition

appeal allowed; cross-appeal dismissed

Orders

  • Ground 4 of Vijay's appeal upheld; the Supreme Court erred in finding it had jurisdiction under section 4 of the Courts Act to enforce the award.
  • Grounds 1-4 of EEEL's cross-appeal dismissed with costs to Vijay.
