A mere hope or possibility that a court may order division of matrimonial assets under s112 of the Women's Charter does not constitute an 'interest in land' for purposes of s115 of the Land Titles Act and cannot support a caveat; only an existing legal or equitable interest, a court order effecting division, or an injunction under s132 (invoking s115(3)(b)) will found a caveatable interest.
