The trial judge erred in excluding evidence that was relevant to the defence to the counterclaim because the dismissed main claim and the counterclaim were inextricably connected; the excluded evidence had a substantial and realistic prospect of making a meaningful difference and the Court of Appeal could not properly evaluate it on paper, therefore a retrial of the counterclaim was required (to be heard in the District Court); the personal (third‑party) costs order against KC and CM was unjust and is set aside; the dismissal of the main claim for failure to furnish security for costs remains unaffected except costs of the main claim ($20,000) to be borne by the Appellant alone.
