The accused, being the driver of the vehicle, was presumed in possession and presumed to have known the nature of the drugs; he failed to rebut those presumptions on the balance of probabilities given the implausibility of his account and surrounding circumstances, and the Prosecution therefore proved the offence beyond reasonable doubt; however the facts showed he acted no more than as a courier under s33B(2)(a).
