The Court held SOCN-E (the Summary of Contract Negotiations terms) governed the timing for serving payment claims and responses; the appellant's Payment Claim, Notice of Intention and Adjudication Application were therefore served in time; although s10(2) is mandatory and breach can invalidate an adjudication, that ground did not apply here; the High Court erred in holding Preliminaries E prevailed; courts may review adjudicators' jurisdictional determinations and objections to mandatory statutory compliance must be raised promptly and can be waived by conduct.
