Procedural Posture

Family Law Adoption; Application to Amend Adoption Order / Appeal Against District Court Dismissal of Application to Amend Adoption Order

  1. 1 Whether the court has jurisdiction to amend an adoption order after it has been made and perfected
  2. 2 Whether the court can vary an adoption order instead of amending it
  3. 3 When the change of name for an adopted child takes legal effect

Ratio Decidendi

The court has no jurisdiction to amend a perfected adoption order to alter the adopted child's name or to direct re-registration of the birth; under s 12 the change of name for an adopted child takes effect only when the adoption order is made and is implemented by the Registrar-General, and the appellants therefore have no legal recourse to alter the birth certificate after perfection of the adoption order (aside from a deed poll which does not change the birth register, or re-adoption only where s 9 permits).
