The Court held the 2004 registration did not create a new entity distinct from the 1962 College; the College is an unincorporated association entitled to the benefit of the charitable purpose trust over the Premises for joint use with the Church; the appellants established on the balance of probabilities that they are current board members; the College's adoption of the VPP doctrine did not amount to a material deviation from the College's fundamental doctrine as expressed in the Westminster Confession and therefore did not breach the trust; appeal allowed and the Judge's contrary finding set aside.
