Yan Jun v Attorney-General

Yan Jun v Attorney-General

Because the Suit included claims that sought damages in respect of personal injuries, s 24A of the Limitation Act applied and imposed a three‑year limitation; the plaintiff had sufficient knowledge by July–October 2009 so the three‑year period expired before commencement of proceedings in April 2013; accordingly the claims were time‑barred and were properly struck out except for the pleaded loss of liberty from false imprisonment which the Assistant Registrar allowed to survive; additionally, wrongful arrest is not a separate tort, there was no prosecution for malicious prosecution, abuse of process did not arise, and qualified privilege defeated the defamation claim.
