Claimant proved a prima facie case by producing invoices, POs, DOs and a creditor statement and part payment; the defendant failed to demonstrate a fair or reasonable probability of a real or bona fide defence, its first counterclaim for breach of an oral distributorship was implausible for want of essential particulars and evidential support, and its conspiracy counterclaim was speculative and did not amount to legal or equitable set-off nor justify a stay of execution; accordingly summary judgment was appropriate and execution should not be stayed.
