The court held that s 357(1) CPC does not authorize ordering a defence counsel to pay prosecution costs directly absent a costs order against the accused and the court's inherent power cannot be used to expand that statutory scheme; CM 32 was frivolous, vexatious and an abuse of process and the accused had conducted the matter extravagantly and unnecessarily such that costs should be ordered against them under s 409 and s 356(1)/(3); accordingly Mr Ravi must reimburse his clients under s 357(1)(b) for any costs they are ordered to pay because his conduct was unreasonable and lacked reasonable competence and expedition.
