The court held that the Applicant failed to prove fraud, misrepresentation or impropriety under s 14(3) and therefore could not deprive the aided Respondent of statutory protection; however the protection under s 12(4)(c) takes effect only from the date a Grant of Aid is filed (including a provisional grant filed in court), thus the Respondent was ordered to pay costs of $20,000 for work done before the provisional Grant of Aid was filed on 13 June 2025.
