Procedural Posture

Direct Constitutional Challenge / Judgment on Application

  1. 1 Whether the Twelfth Amendment is irrational insofar as it relocates Moutse 1 and Moutse 3 from Mpumalanga to Limpopo
  2. 2 Whether the Mpumalanga Provincial Legislature failed to reasonably facilitate public participation as required by section 118(1)
  3. 3 Whether the Repeal Act falls with the constitutional challenge to the Twelfth Amendment

Ratio Decidendi

The challenge to the Twelfth Amendment fails because the amendment is rationally connected to the legitimate objectives of abolishing cross-boundary municipalities and creating viable municipalities, and because the Mpumalanga Provincial Legislature’s public participation process, including the hearings and report, was not shown to be unreasonable in the circumstances. The challenge to the Repeal Act fails with the main challenge.
