Ratio Decidendi

The majority held that this Court's order in Tasima I was the legal causa for the handover of the eNaTIS and related services, that what was transferred was Tasima's business of operating, maintaining, supporting and further developing the eNaTIS, that the business retained its identity when taken over by the RTMC, and that section 197 therefore applied. The effective date of transfer was 5 April 2017, when the RTMC actually took control, because an earlier date would produce inequitable results. The section 18(3) appeal was dismissed as moot and leave refused because it would have no practical effect.
