The delay between the alleged abduction (29 December 2022) and the institution of the application (3 March 2023) was not explained in the founding affidavit. The explanation provided by counsel during argument was insufficient, as the case must be made out in the founding affidavit. The applicant also failed to address why substantial redress could not be afforded in the normal course.
