The applicant failed to discharge the onus of proving ownership of the vehicle. The second respondent's version, which was not rebutted in material respects, established that the applicant's brother did not pay for the vehicle and that ownership never passed to him or the applicant. The invoice indicating 'fully settled' was premised on an exchange of vehicles that never occurred, and monetary payment was not made. The registration of the vehicle in the applicant's name was irregular, as the required change of ownership documentation was not signed. The SAPS seized the vehicle lawfully with the applicant's consent, and there was no evidence to support the claim of unlawful possession....
