The court found that the applicant was entitled to payment of the amounts due under the loan agreements, as the cession in securitam debiti was valid and acknowledged by the respondents. Interest on the amounts accrues from 21 days after the payment certificate date, in accordance with the contract, and not from the date of approval by the North West Tender Board. The managing contractor arrangement did not terminate Itireleng's contract or affect the applicant's rights under the cession. The lack of approval by the Tender Board did not render the cession ineffective, as the respondents had notice and acknowledged the cession, and were bound by prior court orders to pay the applicant....
