Ratio Decidendi

The court found that the Commissioner’s decision to reinstate Mr Blackett was unreasonable given the evidence of a breakdown in the trust relationship between the applicant and Mr Blackett. The applicant operates in a highly security-conscious environment, and the employee’s disregard for previous instructions undermined the necessary trust. The Commissioner failed to properly consider the impact of Mr Blackett’s conduct on the employment relationship. Therefore, the award of reinstatement was set aside and substituted with compensation equivalent to eight months’ salary.
