Procedural Posture

Urgent Application / Application for Release From Detention Pending Criminal Proceedings

  1. 1 Whether the applicant's continued detention at Modderbee Prison is unlawful.
  2. 2 Whether the applicant is entitled to immediate release to apply for asylum under the Refugees Act.
  3. 3 Whether the applicant's arrest and detention are justified under the Immigration Act and pending criminal charges.

Ratio Decidendi

The applicant's detention at Modderbee Prison is not unlawful as he is being held pending criminal prosecution for fraud relating to his use of a falsified study permit to enter South Africa. The applicant failed to approach the authorities for asylum upon arrival and only raised his asylum claim after being confronted with the fraudulent nature of his documents. There is no evidence that he was detained for deportation purposes, nor has any authority ordered his deportation. The court finds that releasing the applicant would interfere with ongoing criminal proceedings in the Magistrate Court. The application for immediate release and interdict against deportation is therefore dismissed.
