The termination of the respondents' rights of residence was not just and equitable as required by section 8(1), and the requirements of section 10(3) were not satisfied. The protection afforded to long-term occupiers and their family members under sections 8(4)(a) and 6(2)(d) was applicable to certain respondents. As the requirements of section 9(2) are cumulative, non-compliance with any part precludes the granting of an eviction order. Consequently, the appeals could not succeed and were dismissed.
