However, the individual applicants were not personally at fault and would suffer significant prejudice if their claim was barred due to their representatives' neglect. The interests of justice required that condonation be granted to allow the matter to proceed. To express the court's displeasure with the representatives' conduct, a cost order was made against both the union and the attorneys, apportioning liability equally.
