Ratio Decidendi

The applicant's statement of claim does not disclose a cause of action for unfair discrimination under section 6(1) of the Employment Equity Act. The pleadings fail to establish that wage differentiation is based on race, as not all category 4-8 employees are black, nor is race a criterion for payment. The claim based on 'status' is also insufficient, as the pleaded status is not a listed ground under the Act. The applicant has not shown that the differential payment could constitute an arbitrary ground within the meaning of section 6(1). Accordingly, the exception is upheld and the statement of claim is struck out.
