Ratio Decidendi

The court found that the Commissioner conducted the proceedings fairly and provided sufficient guidance to the Applicant as a layperson. The Applicant did not apply for a postponement, nor did the circumstances require the Commissioner to intervene further. The Applicant's explanation for the late referral was accepted, but she failed to establish prospects of success in her constructive dismissal claim. The evidence did not support her assertion that the working conditions were intolerable or that her resignation was a result of the employer's conduct. The Commissioner’s decision to refuse condonation was reasonable and cannot be faulted. Accordingly, the review application was dismissed.
