Ratio Decidendi

The court found that the funds collected by the first respondent on behalf of the applicants were intended to be trust monies, as per the management agreements and the Estate Agency Affairs Act. The fact that the funds were deposited into a business account rather than a trust account did not alter their legal character as trust monies. Section 32(8) of the Estate Agency Affairs Act was decisive, providing that such funds do not form part of the insolvent estate. The applicants had identified the amounts owed to them, and the merger of funds in the business account did not defeat their claim.
