The court found that BBM Attorneys were not properly authorised to institute the main application on behalf of the applicant, as no valid resolution was passed at a properly convened meeting with a quorum. The purported resolution of 16 September 2014 was invalid, having been circulated without discussion or approval at a meeting. The trustees' meeting of 9 August 2014 was properly convened and its resolutions valid. The special levy arising from the invalid resolution was set aside. The notification in terms of s 35(5) of the Sectional Titles Act was invalid and must be expunged from the Deeds Office records. The Management Rules registered after the AGM of 15 June 2009 were incorrect...
