Procedural Posture

Review Application / Judgment on Review of Arbitration Award

  1. 1 Whether the Bargaining Council had jurisdiction to arbitrate the dispute.
  2. 2 Whether the dispute referred was properly identified as an unfair dismissal.
  3. 3 Whether a premature referral of an unfair dismissal dispute confers jurisdiction on the arbitrator.

Ratio Decidendi

The Court found that the dispute referred to the Bargaining Council was not identified by the applicant as an unfair dismissal. Even if the dispute could be construed as related to unfair dismissal, it was referred prematurely. The arbitrator did not have jurisdiction to arbitrate the matter, as a premature referral does not clothe the arbitrator with jurisdiction. The content of the Conciliation Certificate has no legal force in this regard. The award was therefore reviewed and set aside for want of jurisdiction.

Court Disposition

The arbitration award was reviewed and set aside for want of jurisdiction.
