Ratio Decidendi

The court found that the order granted by Acting Judge Du Plessis was interlocutory and interim in effect, as the relief granted would be revisited in the main proceedings (Part B). Therefore, section 18(2) of the Superior Courts Act applied, and the filing of an application for leave to appeal did not suspend the operation of the order. Eskom's defence of acting on legal advice was rejected due to insufficient evidence regarding the nature and circumstances of the advice. The court concluded that Eskom's non-compliance was not adequately justified and declared Eskom in contempt of the interim order.
