The Supreme Court of Appeal held that, on the facts pleaded, the rights of the individual members of Club Twelve to the structures were so intertwined with their membership that they could not exist separately. Rule 14 of the Uniform Rules of Court was designed to address precisely this situation, allowing the association to be cited in lieu of its individual members. The court found that the interests of the members were adequately represented by Club Twelve and that the technical defence of non-joinder was not sustainable.
